THRIVINGK9
TRAINING AGREEMENT & POLICIES

It is the client's responsibility to thoroughly read the Training Agreement required for purchasing training services. If booked through Acuity Scheduling, these conditions are outlined on the payment page before purchasing. If booked elsewhere, you would have received a signable electronic agreement required before payment. 

TRAINING AGREEMENT

1. Client agrees that they have hired ThrivingK9, as training professionals, to determine which tools are necessary to help the client train their dog. They understand that they will obtain the best training results by following the instructions of the ThrivingK9 trainer(s). Further, the Client understands that they are solely responsible for their dog's success in the training program.

 

2. Client understands that their dog's success is a direct product of the time and effort they contribute to the dog's training and their willingness to make any lifestyle changes to support the training. The Client understands if they do not prioritize their dog's training daily, the value of the training dramatically diminishes. 

 

3. Hybridized Training Program Clients: Client understands that even though ThrivingK9 is doing intensive training with their dog, they won't see tangible improvement until the skill transfer lessons are completed and an understanding is developed. Further, the Client understands that their dog is a living breathing animal that will behave as such, regardless of intensive training. It is their responsibility to continue working on their dog's skills consistently and regularly to maintain the training progress made within the intensive training outings. 

4. It is the Client's responsibility to use the training tools the way ThrivingK9 teaches them. The Client understands that the misuse of training tools such as a prong collar, remote training collar, compressed air can, spray bottle, leash, training collar, harness and/or anything else that is used to aid in the training of the dog may result in the termination of the business relationship. No refunds will be given.

5. Client understands that behavior modification does not happen overnight and will take daily effort on their part. Client acknowledges that behavior modification is a comprehensive process that requires management, lifestyle changes and relationship adjustments.

6. Client acknowledges that behavior modification for sudden and/or unpredictable anxiety, aggression, sudden and/or unpredictable extreme fear and/or extreme reactivity should only be applied after the dog has been seen by a licensed veterinarian to rule out any possible medical causes for the behavior. 

 

7. Client understands that ThrivingK9 may cancel or adjust training sessions at their discretion if weather is unsafe. Per safety measures, training does not happen above 25 degrees Celsius, below -5 degrees Celsius dependent on breed or in extreme storms. 

8. Client understands that in order to succeed, they will communicate honestly, be open to feedback, assistance and to create the time and energy to participate fully in the training program.

9. If the Client does not accurately disclose their dog's bite history and/or the level of aggression, ThrivingK9 can terminate the business relationship at their discretion and no refunds will be given.

10. If the Client's dog has an undisclosed bite history and injures Sydney Meyers, ThrivingK9 or anyone else during a training session, group class or club training, the Client understands that the local SPCA and Animal Control will be notified at ThrivingK9's discretion. The business relationship may be terminated at ThrivingK9's discretion.

11. The Client certifies that ThrivingK9 will not be held liable for any damage the dog does to property, other animals or people, during or after training.

12. The Client certifies that their dog is in good health, is free from fleas, ticks, and all other parasites, and has received all required core vaccinations, including: canine distemper, parvovirus, hepatitis, parainfluenza, Bordetella, and rabies. 

 

13. The Client agrees that they are under a continuing obligation to report to ThrivingK9 any signs of injury, illness or infection in their dog for the duration of training.

14. In the event that the Client's dog requires emergency veterinary treatment while attending any training program, they agree that ThrivingK9, in its sole discretion, will transport their dog to an appropriate veterinary facility for treatment and will immediately attempt to contact the Client. The Client assumes all financial responsibility for veterinary treatment.

15. The Client understands that dogs are animals and even in the most controlled and well-supervised environments, they may engage in inappropriate animal behavior. The Client agrees that ThrivingK9 may use “corrections” to interrupt and/or stop my dog’s inappropriate behavior. Such corrections include, but are not limited to, leash corrections, the use of spray bottles of water and compressed air canisters.

16. The Client understands that ThrivingK9 reserves the right to adjust rates or policies without notice.

17. The Client understands that any remaining balance or unused training will expire 90 days after the last date of training, including the evaluation, attended.

18. The Client understands that if they must cancel or reschedule a training session, they must provide 24 hours advance notice. Failure to do so will result in a rescheduling fee of $50.00 that is to be paid before the next training session is scheduled.

19. The Client understands that they are responsible for reading any literature provided by ThrivingK9 or by the manufacturers of any products used in their dog’s training.

20. The Client agrees that training collars will not be left on their dog while resting, over night or when training is not happening.

21. Missed group classes cannot be made up without express consent from management. ThrivingK9 reserves the right to remove anyone from group classes, for any reason.

22. The Client understands that there are no guarantees that reactivity and/or aggression will completely recede with training. The Client agrees that if their dog has displayed or continues to display aggression toward other dogs and/or people, it is their responsibility to muzzle their dog and to avoid potential problem situations at all times, not solely during training sessions.

23. The Client agrees that in the event their dog engages in an act of aggression toward another dog or person while participating in dog training, ThrivingK9 may, in their sole discretion, use reasonable physical force to interrupt and stop the aggression. The Client further agrees that they are solely responsible, financially or otherwise, for any harm or damage to other dogs, persons, and/or property arising out of their dog’s behavior.

24. The Client agrees to allow ThrivingK9 to photograph and/or videotape their dog for use in print, publication, and promotion of ThrivingK9.

25. Acknowledgement of Risk: The Client understands that attendance and participation in ThrivingK9's dog training, group classes, training club, daycare or boarding is not without risk to the Client, to their dog(s), and/or to third parties, and/or the dog(s) of third parties. The risks include, but are not limited to, the risk of property damage, personal injury from dog bites, scratches, or other injuries, death, infectious disease, and parasites. 

 

The Client agrees that their dog’s attendance and participation in ThrivingK9 dog training, daycare or boarding is voluntary and was undertaken with their knowledge of the known risks and other risks that may result from their dog’s participation in dog training.

26. Refund Policy

  • ONCE PAYMENT IS RECEIVED, ALL TRAINING SERVICES ARE NON-REFUNDABLE.

  • CANCELLED TRAINING SERVICES, GROUP CLASSES AND PROGRAMS WILL BE CREDITED TO FUTURE TRAINING FOR 1 CALENDAR YEAR.

  • PAYMENT IN FULL IS REQUIRED BEFORE THE START OF TRAINING SERVICES UNLESS OTHERWISE DISCUSSED.

  • THERE ARE NO REFUNDS FOR EVALUATIONS UNDER ANY CIRCUMSTANCE.

 

If you are not satisfied with the outcome of training with ThrivingK9 and you participated fully in the training program by completing homework, recorded videos of your training and/or gave weekly updates outside of the in-person training and utilizing the resources ThrivingK9 has provided to you at its fullest, then a training plan will be worked out for you to address your concerns.

27. The Client understands that if there is little to no improvement by half way into a training program, Sydney Meyers has the right to terminate the business relationship and no refunds will be given. The Hybridized Training Program is exempt from this policy.

 

28. The Client understands that sessions are not transferrable without written consent from Sydney Meyers. 

 

29. The Client understands that on the website, https://www.thriving-k9.com, has all of the up to date information in regards to Training Agreement and policies.

Assumption of Risk: The Client agrees that they have been informed of the risks associated with dog training and have assumed the risk of their dog’s attendance and participation in ThrivingK9 dog training, daycare or boarding.

Release of Liability: In consideration for the Client's dog’s attendance and participation in ThrivingK9 dog training, daycare, or boarding, the Client fully releases ThrivingK9 from any and all claims and/or liability arising out of their dog’s attendance at, or participation in, dog training, including all claims for personal injury, wrongful death, and property damage. The Client agrees to defend, indemnify, and hold harmless ThrivingK9 from any and all claims and costs, including attorney’s fees, arising out of or relating to the Client's dog’s attendance at, or participation in, ThrivingK9 dog training, daycare or boarding, including claims of negligence against ThrivingK9, its employees, officers, agents and/or volunteers.

Merger. This Agreement constitutes the final, exclusive agreement between the parties relating to the dog training services contained in this Agreement. All earlier and contemporaneous negotiations and agreements between the parties on the matters contained in this Agreement are expressly merged into and superseded by this Agreement.

By registering and paying for our training services you warrant that:

  • You are legally capable of entering into binding contracts and agreements;

  • You are at least 18 years old;

  • That all information you provide us with is materially true and accurate at all times and not misleading in any way;

  • You are acknowledging that you have carefully read the Training Agreement, Refund Policy, Assumption of Risk, Liability Release and understand its contents.
